MANILA, Philippines — Police will amend the criminal complaints filed against the shooter in the Antipolo road rage incident after one of the four wounded victims died on Monday.

Lt. Col. Ryan Manongdo, Antipolo police chief, yesterday said the charges against the suspect, identified as Kenneth Bautista, 28, would be upgraded to murder, two counts of frustrated murder, and violation of the Omnibus Election Code and Republic Act (RA) 10591, or the Comprehensive Law on Firearms and Ammunition.

Earlier, the police filed charges of multiple frustrated homicide and violation of the election gun ban and RA 10591 against Bautista.

Manongdo said the changes in the complaints came after one of the motorcycle riders that the suspect allegedly shot died on Monday.

“We will need a death certificate to upgrade or amend the complaint that we filed,” he said.

In a text message to The STAR, Manongdo said investigators intend to file the amended complaint before the Office of the City Prosecutor today.

The three other victims, including Bautista’s partner Camille, have been discharged from the hospitals.

Records showed Bautista and his family were in a sport utility vehicle when they figured in a quarrel with three motorcycle riders along Marcos Highway in Barangay San Jose.

Video footage of the incident went viral on social media. It showed the suspect engaging in a fistfight with two riders before he drew his gun.
